These Terms and Conditions ("Terms") govern your use of newyorkesim.com (the "Site") and any eSIM data plan purchased through it. NewYorkeSim is a destination eSIM store operated as a "doing business as" (DBA) of VIA eSIM. References to "NewYorkeSim," "VIA eSIM," "we," "us," and "our" refer to the same operating company. By using the Site or purchasing a plan, you agree to these Terms.

1. About NewYorkeSim

NewYorkeSim markets and sells eSIM data plans for travel to New York City. Plans are provisioned, activated, and supported through VIA eSIM’s platform and network partnerships. NewYorkeSim is not a mobile network operator; it resells access to mobile data networks through VIA eSIM.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase a plan on this Site. By placing an order, you confirm that you meet this requirement.

3. Orders, Pricing, and Payment

  • All prices are listed in U.S. dollars unless stated otherwise and are subject to change without notice.
  • Payment is processed securely by VIA eSIM at the time of purchase.
  • You are responsible for providing accurate billing and device information at checkout.
  • Orders may be declined or canceled at our discretion, including in cases of suspected fraud or pricing errors.

4. eSIM Activation and Device Compatibility

It is your responsibility to confirm that your device is eSIM-compatible and network-unlocked before purchasing a plan. Most eSIM plans activate on first use rather than at the time of purchase; we recommend installing your eSIM before you travel and activating your data plan on arrival. NewYorkeSim is not responsible for activation issues caused by incompatible or locked devices.

5. Data Plans and Usage

Each plan includes a specific data allowance, validity period, and network coverage as described on the Plans page at the time of purchase. Data speeds may vary based on network conditions, device, and location, and are not guaranteed. Unused data does not carry over between plans unless explicitly stated.

6. Refunds and Cancellations

Because eSIM plans are digital products delivered instantly, purchases are generally non-refundable once the eSIM has been installed or activated. If you experience a technical issue preventing installation or activation, contact support before your trip so we can help resolve it or, where appropriate, issue a refund.

7. Acceptable Use

You agree not to use NewYorkeSim plans for unlawful purposes, to resell data plans without authorization, or to interfere with the network infrastructure provided by VIA eSIM or its partners.

8. Intellectual Property

All content on this Site, including text, graphics, logos, and design, is owned by or licensed to VIA eSIM and may not be copied or used without permission.

9. Disclaimer of Warranties

The Site and plans are provided "as is" and "as available." We do not guarantee uninterrupted network coverage, specific data speeds, or that the Site will be error-free.

10. Limitation of Liability

To the fullest extent permitted by law, NewYorkeSim and VIA eSIM are not liable for indirect, incidental, or consequential damages arising from your use of the Site or a data plan, including lost data, missed connections, or travel disruptions.

11. Governing Law

These Terms are governed by the laws applicable to VIA eSIM’s place of business, without regard to conflict of law principles.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
